1. Acceptance of Terms

These Terms of Service (“Terms”) govern your access to and use of Driven To Show (“we,” “us,” or “our”) and the services we provide for car show organizers and participants. By accessing or using the service, you agree to these Terms. If you use the service on behalf of an organization, you represent that you are authorized to accept these Terms for that organization.

2. Accounts and Eligibility

  • You must be at least 18 years old and able to form a binding contract to use the service.
  • You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
  • Provide accurate information and keep it updated, including organizer profiles and event details.

3. Use of the Service

  • Use the service only for lawful purposes and in accordance with these Terms.
  • Do not interfere with or disrupt the service, bypass security measures, or misuse access to others' data.
  • Comply with all applicable laws and regulations when hosting, promoting, or participating in car shows.
  • Organizers are responsible for the accuracy of event information and for honoring commitments made to participants.

4. Content and Data

  • You retain ownership of content you submit (event details, media, registrations, messages).
  • You grant us a non-exclusive license to host, display, and process your content as needed to provide the service.
  • Do not submit content that is unlawful, infringing, or violates third-party rights.
  • Organizers must obtain any permissions required to post participant information or images.

5. Payments

  • Payment processing is handled by our payment processor; card data is not stored on our servers.
  • Organizers are responsible for pricing, refunds, chargebacks, and compliance with applicable payment laws.
  • Fees and charges, if any, will be disclosed before purchase; taxes are your responsibility unless stated otherwise.

6. Privacy

Our use of personal data is described in our Privacy Policy. By using the service, you consent to the collection and use of information as described there. Organizers must provide appropriate notices and obtain any required consents from participants.

7. Prohibited Conduct

  • Reverse engineering, scraping, or harvesting data beyond your authorized access.
  • Uploading malware or engaging in activity that could harm the service or its users.
  • Impersonation, misrepresentation, or misuse of another user’s data.
  • Interfering with events, communications, or payments without authorization.

8. Intellectual Property

The service, including software, branding, and content we provide, is owned by us or our licensors and protected by intellectual property laws. Except for the limited rights expressly granted, no license or ownership is transferred to you.

9. Third-Party Services

The service may integrate with third-party services (such as payment processors or analytics). Your use of those services is subject to their terms and privacy policies. We are not responsible for third-party services and do not control their practices.

10. Disclaimers

The service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be uninterrupted, secure, or error-free, or that event outcomes will meet expectations.

11. Limitation of Liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or goodwill, arising from or related to your use of the service. Our total liability for any claim is limited to the amount you paid us for the service in the 3 months preceding the claim (or $100, if greater).

12. Indemnification

You agree to indemnify and hold us harmless from claims, losses, and expenses (including reasonable attorneys’ fees) arising from your content, your use of the service, your events, or your violation of these Terms or applicable law.

13. Termination

We may suspend or terminate access for any violation of these Terms or to protect the service or its users. You may stop using the service at any time. Sections that by their nature should survive termination will survive (including payment obligations, IP protections, disclaimers, and limitations of liability).

14. Governing Law and Disputes

These Terms are governed by the laws applicable in our principal place of business, without regard to conflict of law principles. Any disputes will be resolved in the courts located there, unless otherwise required by applicable law.

15. Changes to These Terms

We may update these Terms from time to time. If changes are material, we will provide notice through the service or other appropriate means. Continued use after changes take effect constitutes acceptance of the updated Terms.
