1. Acceptance of Terms
These Terms of Service (“Terms”) govern access to and use of Driven To Show
(“Driven To Show,” “we,” “us,” or “our”), including our websites,
software, APIs, and related services (collectively, the “Service”). By using the Service,
you agree to these Terms. If you use the Service on behalf of an organization, you represent
that you are authorized to bind that organization.
2. Accounts and Eligibility
- You must be legally capable of entering into a binding agreement to use the Service.
- You are responsible for account security, including passwords, one-time login links/codes,
and any activity under your account.
- You must provide accurate, complete, and up-to-date information for accounts, events, and
registrations.
- You must promptly notify us if you suspect unauthorized account access or misuse.
3. Service Scope
Driven To Show provides event and car show operations software, including features such as:
- Event setup, scheduling, and organization pages.
- Vehicle registration, attendee management, and check-in workflows.
- Vehicle profile creation and media/image uploads.
- Judging, scoring, trophies, People’s Choice, and attendee choice workflows.
- Spectator ticket sales, checkout, ticket delivery, and scanning/check-in tools.
- Invoice and registration payment processing through supported payment processors.
- Email notifications, ticket/registration confirmations, and organizer communications.
- Administrative exports and reporting features.
4. Authorized and Prohibited Use
- Use the Service only for lawful, authorized purposes.
- Do not bypass security controls or attempt unauthorized access to systems or data.
- Do not upload malware, abusive content, fraudulent entries, or unlawful material.
- Do not scrape, harvest, bulk-download, or reuse data beyond your authorized scope in the
Service.
- Do not manipulate voting, check-in, ticketing, judging, payment, or reporting workflows.
5. Organizer and User Responsibilities
- Event organizers are responsible for event content accuracy, participant communications,
rules, awards, and operational decisions.
- Organizers are responsible for obtaining required permissions and legal rights for
participant information, photos, and event materials.
- Organizers are responsible for compliance with applicable laws (including consumer,
payment, privacy, and event-related laws).
- Users and organizers are responsible for data they submit, including custom form fields and
content entered into event, registration, and ticketing workflows.
6. Content, Media, and License
- You retain ownership of content you submit, such as vehicle details, attendee data, event
configuration, images, form responses, and communications.
- You grant us a non-exclusive, worldwide, royalty-free license to host, process, display,
copy, transmit, and store your content as needed to operate, secure, and improve the
Service.
- You represent and warrant that you have the necessary rights and permissions for submitted
content.
- Some event/vehicle/ticket information may be visible to authorized staff, participants, or
public viewers depending on event settings.
7. Data Processing in the Service
To provide the Service, we process data related to account access and event operations,
including:
- Account/profile data (for example name, email, phone, zip code, roles).
- Event and registration data (for example attendee details, vehicle data, custom form
fields, group assignments, approvals, check-in status).
- Ticketing and payment-related data (for example ticket purchases, transaction references,
payment status, and invoice/payment records).
- Media uploads (for example attendee, vehicle, and show images).
- Security and anti-abuse data (for example IP-derived request metadata, session/cookie data,
verification tokens, device fingerprint values, and geolocation verification for certain
ballot workflows).
- Communication metadata (for example delivery/open/click tracking for service emails).
- Analytics and diagnostics data used to operate and improve the Service.
8. Privacy and Data Rights
Our processing of personal information is described in our
Privacy Policy. By using
the Service, you acknowledge that data may be processed as described there. Organizers are
responsible for their independent handling of participant data and for any notices/consents
required by law.
9. Communications
- You consent to transactional communications needed for account, event, registration,
ticketing, payment, and security operations.
- Marketing or non-transactional messages may be subject to your communication preferences or
opt-out settings where applicable.
- You are responsible for recipient lists and consent practices for organizer-directed
communications sent through or related to the Service.
10. Payments, Billing, and Refunds
- Payment processing is provided by third-party payment processors (such as Stripe). Full card
numbers are processed by those providers and are not stored by us as full PAN data.
- Organizers are responsible for pricing, taxes, refund policies, disputes, and chargeback
handling for their events.
- You authorize charges for applicable fees and purchases submitted through the Service.
- We may suspend payment-related functionality if processor configuration, fraud controls, or
compliance requirements are not met.
11. Third-Party Services
The Service may rely on third-party services including cloud hosting, email delivery,
analytics, captcha/anti-bot verification, mapping/location tools, and payment processors. Your
use of those services is subject to their terms and policies. We are not responsible for
third-party services we do not control.
12. Intellectual Property
The service, including software, branding, and content we provide, is owned by us or our
licensors and protected by intellectual property laws. Except for the limited rights expressly
granted, no license or ownership is transferred to you.
13. Suspension and Termination
We may refuse service, suspend access, or terminate access to all or part of the Service for
any person or organization, at any time, for any reason, at our sole discretion, to the
extent permitted by law, including for violations of these Terms, legal or security risks,
non-payment, abuse, or to protect users and the Service. We may do so with or without prior
notice, unless notice is required by applicable law. You may stop using the Service at any
time. Provisions that should survive termination will continue in effect.
14. Disclaimers
The service is provided “as is” and “as available” without warranties
of any kind, whether express or implied, including merchantability, fitness for a particular
purpose, or non-infringement. We do not warrant that the service will be uninterrupted, secure,
or error-free, or that event outcomes will meet expectations.
15. Limitation of Liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special,
consequential, or punitive damages, or for lost profits, revenues, data, or goodwill, arising
from or related to your use of the service. Our total liability for any claim is limited to the
amount you paid us for the service in the 3 months preceding the claim (or $100, if greater).
16. Indemnification
You agree to indemnify and hold us harmless from claims, losses, and expenses (including
reasonable attorneys’ fees) arising from your content, your use of the service, your
events, or your violation of these Terms or applicable law.
17. Governing Law and Disputes
These Terms are governed by the laws applicable in our principal place of business, without
regard to conflict of law principles. Any disputes will be resolved in the courts located
there, unless otherwise required by applicable law.
18. Changes to These Terms
We may update these Terms from time to time. If changes are material, we will provide notice
through the service or other appropriate means. Continued use after changes take effect
constitutes acceptance of the updated Terms.
